Mr. Prince Chauhan, Advocate for the applicant. Mr. Dinesh Chauhan, A.G.A. for the State of Uttarakhand. 2. This third bail application has been moved by the applicant seeking regular bail in F.I.R. No.287 of 2022, under Sections 302, 323, 504 & 34 I.P.C., registered at Police Station Bajpur, District Udham Singh Nagar. 3. The 1st and 2nd bail applications moved by the applicant were rejected on merits vide orders dated 03.10.2023 and 19.06.2025. 4. Learned counsel for the applicant submits that applicant has falsely been implicated in the instant crime and is languishing in jail since 17.06.2022. He submits that, as per the post-mortem report, the cause of death was intracranial bleeding resulting from a head injury, and that the post-mortem findings and the doctor’s statement are not in full corroboration. It is contended by learned counsel for the applicant submits that co-accused, namely, Vikram has already been enlarged on bail by this Court in BA3 No.61 of 2025 vide order dated 31.10.2025. He submits that this is a case of parity and in case, the applicant is granted bail, he will not misuse the same and will furnish the bail surety as per the satisfaction of this Court. 2026:UHC:9 5. Learned State Counsel has vehemently opposed the prayer for bail; however, he fairly concedes that, as per the medical report on record, no injury has been found to have been caused by any sharp-edged weapon. 6. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage on the ground of parity. 7. The bail application is allowed. 8. Let the applicant, namely, Balvir Singh be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
