JUSTICE S.R.KRISHNA KUMAR - 3 - HC-KAR NC: 2026:KHC:23390 WP No. 13114 of 2026 ORAL ORDER In this petition petitioner seeks the following reliefs: "a) Issue a Writ of Mandamus: Directing the Respondnet No.1 and Respondent No.2 to consider the representation of the Petitioner for the post of Director of Prosecution within a time- bound period of ten days, vide Annexure-'E' in accordance with law; b) Issue a Writ of Mandamus: Directing the Respondent No.1 and Respondent No.2 to remove Respondent No.3 from incharge post of Directorate of Prosecution and appoint Petitioner for the post of Director of Prosecution vide Annexure- 'B' as per the order given by Secretary of Government Home Department. c) Grant such other relief or further reliefs as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case, in the interest of justice and equity." 2. Learned counsel for the petitioner submits that the petition may be disposed of directing respondent Nos.1 and 2 to consider the representation submitted by the petitioner within a stipulated time frame. 3. Per contra, learned AGA submits if reasonable time is granted, respondent Nos.1 and 2 would consider the representation submitted by the petitioner and any further representations/documents to be submitted by the petitioner and hear the petitioner as well as the respondent No.3 and take - 4 - HC-KAR NC: 2026:KHC:23390 WP No. 13114 of 2026 appropriate decision/pass appropriate orders in accordance with law. 4. In view of the aforesaid facts and circumstances and submissions made by both sides, I deem it just and appropriate to dispose of this petition directing respondent No.2 to consider the representation at Annexure-E submitted by the petitioner and take appropriate decision/pass appropriate orders in accordance with law after hearing the petitioner as well as respondent No.3 within a period of 4 weeks from the date of receipt of copy of this order. 5. Liberty is reserved in favour of the petitioner as well as respondent No.3 to submit representation, documents etc. before respondent No.2, who shall consider the same and proceed further in accordance with law.
