HC-KAR NC: 2026:KHC:2950 WP No. 28798 of 2025
ORAL ORDER Heard Sri.Gowtham who represents Sri.D.C.Narayana Swamy learned counsel on record for the petitioner. Seeking the Court to issue a writ of certiorari or any other appropriate writ setting aside the order that is passed by the Court of V Additional Principal Judge, Family Court, Bengaluru on I.A. No.2 in Criminal Miscellaneous Case No. 529/2023 dated 09.05.2025 the present writ petition is filed. 2. Through the impugned order Family Court directed the petitioner herein to pay his wife a sum of Rs.5,000/- per month towards interim maintenance and aggrieved by the order thus passed the present writ petition is filed. 3. Learned counsel for the petitioner submits that the respondent wife is gainfully employed and she has got her own sources of earnings and therefore the petitioner is not liable to pay any amount. On a query posed by this Court, whether the petitioner produced any material before the Family Court to show the alleged occupation and earnings of his wife, learned counsel fairly states that no such proof was produced. - 4 -

4. It is not in dispute that the petitioner-husband is working as waterman in Vaddarahalli Village Panchayath.
As per his own statement he is earning Rs.20,000/- per month. He has not produced any documents to show that he has got any other obligations or liabilities. Therefore, this Court is of the view that a sum of Rs.5,000/- granted towards interim maintenance is highly justified. Therefore, the writ petition is dismissed. Sd/- (DR.CHILLAKUR SUMALATHA) JUDGE
