JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition petitioners seek the following reliefs: “(i) Issue a writ in the nature of mandamus directing the learned IV Addl. District & Sessions Judge, Doddaballapura, to dispose of the I.A.No.1 in M.A.No.10002/2025 vide Annexure – E1, in accordance with law, within the time frame as deemed fit by this Hon’ble Court; (ii) Issue such other writ or order or direction as this Hon’ble Court deems just and proper in the facts and circumstances of the case, in the interest of justice.” 2. Learned counsel for the petitioners and learned counsel for respondents jointly submit that the First Appellate Court, who has posted M.A.No.10002/2025 on 28.04.2026 may be directed to prepone / advance the appeal from 28.04.2026 to 16.02.2026 and direct the First Appellate Court to dispose of the appeal on merits within a stipulated time frame by continuing the interim orders passed by this Court in the present petition. - 5 - HC-KAR NC: 2026:KHC:5456 WP No. 28732 of 2025 3. The joint submission is placed on record. 4. Accordingly, the petition stands disposed of directing the First Appellate Court to prepone / advance M.A.No.10002/2025 from 28.04.2026 to 16.02.2026. 5. Liberty is reserved in favour of the petitioners to file application seeking preponement / advancement of the aforesaid appeal. 6. The First Appellate Court is directed to prepone / advance M.A.No.10002/2025 from 28.04.2026 to 16.02.2026 and dispose of the appeal within a period of one month from 16.02.2026. 7. It is further directed that till disposal of the appeal in M.A.No.10002/2025, the interim order granted by this Court in the present petition on 09.10.2025 shall continue to remain in force and operate between the parties without prejudice to their rights and contentions. - 6 - HC-KAR NC: 2026:KHC:5456 WP No. 28732 of 2025 8. It is made clear that the First Appellate Court shall dispose of the appeal without being influenced by the findings and observations recorded in the present petition. 9.
