B.A. No. 159 of 2026

... … Petitioner
Versus The State of Jharkhand ... … Opposite Party
---------
CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY
---------
For the Petitioner : Mr. Sahil, Advocate
For the State : A.P.P.
--------- 03/17.03.2026 Heard Mr. Sahil, learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is an accused in connection with Bariyatu P.S. Case No. 208 of 2025.
It has been alleged that the nephew of the informant was taken away by the petitioner on a motorcycle and he did not return and later on his dead body was recovered.
Submission has been advanced by the learned counsel for the petitioner that the petitioner has been implicated on account of the fact that the deceased was last seen with the petitioner. It has also been submitted that on 31.07.2025 the petitioner and the deceased left on a motorcycle and the dead body was recovered on 03.08.2025 and since there was no close proximity to the recovery of the dead body from the time the deceased was seen with the petitioner the petitioner deserves to be released on bail.
Learned A.P.P. has opposed the prayer for bail of the petitioner.
Regard being had to the fact that the only incriminating circumstance against the petitioner appears to be the deceased being last seen with him, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Ranchi in connection with Bariyatu P.S. Case No. 208 of 2025.
