ORDER DATED 21/06/2023 IN WP NO.23378/2022 PASSED BY THE LEARNED SINGLE JUDGE IN THE INTEREST OF JUSTICE AND EQUITY.
THIS APPEAL, COMING ON FOR PRELIMINARY HEARING, THIS DAY, JUDGMENT WAS DELIVERED THEREIN AS UNDER:
CORAM: HON'BLE MRS. JUSTICE ANU SIVARAMAN and HON'BLE MR. JUSTICE VIJAYKUMAR A. PATIL

This intra Court appeal is filed challenging the order of the learned Single Judge dated 21.06.2023 passed in W.P.No.23378/2022 (S-RES), wherein the writ petition filed by the appellant was dismissed. 2. the post of Anganwadi helper solely for a trivial reason that the marks card submitted by her did not have her name on it. It is further submitted that the appellant ought to be able to submit the marks card with her name on it and be re-considered for the post of Anganwadi helper as she has secured the highest marks compared to all the other candidates. Hence, he seeks to allow the appeal. 3. Per contra, Smt.Pramodhini Kishan, learned Additional Government Advocate appearing for the respondents supports the impugned order of the learned Single judge and submits that the learned Single Judge, after rightly considering the fact that the application submitted by the appellant was incomplete proceeded to dismiss the petition which does not call for any interference. Hence, she seeks to dismiss the appeal. 4. We have heard the submissions of the learned counsel for the appellant, the learned Additional

Government Advocate for the respondents and meticulously perused the material available on record. We have given our anxious consideration to the submissions advanced and the material available on record. 5. The pleading and evidence on record indicates that the respondent No.1 through respondent No.2 issued an online notification dated 28.10.2021 calling for applications for 19 posts of Anganwadi helper on honorarium basis. The appellant filed her application for the post of Anganwadi helper of Motamakalahalli Anganawadi Centre, Chintamani Taluk, Chikkaballapur District, along with all the documents. The Selection Committee in-charge of considering the applications, in its meeting dated 04.01.2022 noticed that the name of the appellant was absent in 9th marks card and declared her to be ineligible.
The appellant submitted a representation dated 08.09.2022 to the respondent No.2 seeking an endorsement as to why one K.V.Nagarathnamma who had scored less marks compared to the appellant, has been

selected to the post. The respondent No.2, in response to the same, issued an endorsement dated 20.09.2022 stating that in the meeting of the Selection Committee dated 04.01.2022, it was noticed that the marks card submitted by the appellant did not have her name and hence, her application was not considered for selection. The appellant, being aggrieved by the endorsement filed a writ petition. The learned Single Judge, after considering the material on record observed that the application submitted by the appellant in terms of the notification dated 28.10.2021 was incomplete and that the endorsement issued by the respondent No.2 was just and proper. Admittedly, on the date of consideration of the application of the appellant, the eligibility document i.e. the marks card was not available and the Authorities are neither expected to hold rowing enquiry by summoning the appellant to produce the document nor can they consider the document submitted after the last date for filing of the application. The said finding of the learned

Single Judge is in consonance with the material on record, which does not call for any interference. 6. Accordingly, the writ appeal is devoid of merit and the same is rejected. Consequently, I.A.No.2/2023 stands disposed of. Sd/- (ANU SIVARAMAN) JUDGE
