Issue a writ of mandamus or any other writ or direction or order in nature of writ, directing the Respondent No.1 to 6 to settle the petitioner salary, salary dues and salary benefits from the date of suspension to till the date of retirement on attaining the age of superannuation (i.e.from 08.05.1993 to 31.01.2016) of Rs.72,51,400-00 (Rs. Seventy two lakhs fifty one thousand and four hundred.) along with interest 12% Per annum, compounded from the date, payment fell due, till the date of its payments in terms of the order passed by the division bench of this Hon'ble Court in W.A.No.481/2008 C/W C.C.C. (Civil) No. 663/2007 dated 08.09.2008 reported in 2009 (3) K.L.J. 271 (Annexure-E); and Civil Appeal No.2704-06 of 1979 dated 21.04.1989 reported in AIR 1989 SC 1607 (Annexure-F) and W.A.No.1444/1983 dated 12.08.1985 reported in L.L.R.1985 (Kar) 3979 at (Annexure- G) under the facts and circumstances of the case and - 4 - HC-KAR NC: 2026:KHC:23446 WP No. 12976 of 2026 And 2. Pass such other orders as this Hon'ble Court may deem fit in the facts and circumstances of the case, including the award of the costs of this petition, in the interest of justice and equity." 2. Heard learned counsel for the petitioner and learned AGA for the respondents and perused the material on record. 3. It is the grievance of the petitioner that his representation dated 23.02.2026 at Annexure- H submitted to the respondents has not been considered so far by respondents nor any order has been passed on the same. Under these circumstances, the petitioner is before this Court by way of present petition. 4. Per contra, learned counsel for the respondents submits that if reasonable time is given, the respondents would consider and pass necessary order on the said representation. 5. In view of the aforesaid facts and circumstances and rival submissions, the respondents are hereby directed to address the grievances of the petitioner and consider his representation dated 23.02.2026 at Annexure - H and pass appropriate order - 5 - HC-KAR NC: 2026:KHC:23446 WP No. 12976 of 2026 bearing in mind Annexures – E, F and G and in accordance with law, within a period of three months from the date of receipt of a copy of this order. 6.
