V S R ANJANEYALU The Court made the following: 3 THE HON’BLE SRI JUSTICE BATTU DEVANAND & THE HONOURABLE SMT JUSTICE SUNITHA GANDHAM FAMILY COURT APPEAL No.17 of 2010 JUDGMENT: (Per Hon’ble Sri Justice Battu Devanand) This appeal is filed against order dated 18.11.2009 passed in O.P.No.386 of 2008, on the file of the Family Court, Visakhapatnam. 2. The appellant is the wife and the respondent is the husband. The said O.P. filed by the petitioner-husband therein, seeking dissolution of the marriage under Section 13(1) (ia) and (ib) of the Hindu Marriage Act. 3. By order dated 18.11.2009, the Family Court, Visakhapatnam, allowed the said petition and the marriage between the parties is dissolved. 4. Aggrieved by the said order, the present appeal is filed by the appellant-wife herein, in the year 2010. 5. When this case came up for hearing on 23.06.2026, a Coordinate Bench of this Court, having considered the facts and circumstances of the case and both the parties are senior citizens aged above 75 years, to put an end to the issues between them, directed the appearance of the parties before this Court for effective interaction, along with their children. 6. Today, the appellant is present before this Court along with her younger daughter, namely, Meesala Jyothsna, but the respondent did not appear. 4 7. Learned counsel for the respondent submits that he could not contact the respondent and his whereabouts also not known to him. 8. When this Court interacted with the appellant, she categorically said that she does not want to prosecute the appeal proceedings further. In view of the lapse of several years, there is no matrimonial relationship between her and the respondent. She wants to live peacefully by closing this litigation. 9. Considering the statement made by the appellant, her interest to put an end to this litigation and her intention to withdraw this appeal, permission is granted in the interest of the appellant to withdraw this appeal. 10. Accordingly, this Family Court Appeal is dismissed as withdrawn. There shall be no order as to costs.
