For Petitioners : Mr.V.Malaiyendran For Respondent : Mr.P.Samuel Gunasingh Government Advocate (Crl.Side) ORDER The present petition has been filed by A4, A8, A18, A27, A28, A29, A35, A42, A51, A52, A54, A57 seeking to quash the charge sheet in STC No.42 of 2024 on the file of the learned Judicial Magistrate, Paramakudi, wherein, the petitioners are charged with the offence under Sections 143, 341 of IPC. 2.Perusal of the charge sheet reveals that 64 accused persons, who belong to a political party have unlawfully assembled and blocked the road protesting as against the arrest of a person. 2/5 https://www.mhc.tn.gov.in/judis Crl.OP(MD) No.13621 of 2026 3.The learned counsel appearing for the petitioners submits that already A1, A19, A23 and A25 have filed Crl.OP(MD) No. 10673 of 2025 before this Court for quash of the charge sheet and the same was allowed by this Court on 21.01.2026. He further submitted that the charge sheet does not disclose any offence against the petitioners. 4.Heard the learned counsel appearing for the petitioners and perused the material available on record. 5.As could be seen from the charge sheet, the petitioners and others who belong to a National Political Party are said to have blocked the road protesting as against the arrest of a particular person. There is no allegation of any inconvenience to the general public or damage to the public property. 6.That apart, as against the other accused persons, who stand on the same footing, charge sheet has been quashed by this Court in Crl.OP(MD) No. 10673 of 2025 on 21.01.2026. 3/5 https://www.mhc.tn.gov.in/judis Crl.OP(MD) No.13621 of 2026 7.In view of the said facts, continuation of the criminal proceedings against the petitioners herein would only be an abuse of process of law. Hence, the charge sheet in STC No.42 of 2024 on the file of the learned Judicial Magistrate, Paramakudi stands quashed not only as against the petitioners, but also against the non petitioners, who also stand on the same footing as that of the petitioners also stands quashed.
