JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court seeking the following prayers: "a) Quash the entire proceedings in C.C.No.21887/2025 for prosecuting the petitioner under section 305(a) of BNS Act, 2023, pending in Cr.No.0034/2025, registered by Giri Nagar police station, on the file of 37th ACJM, at Bangalore. b) Pass such other order/s as this Hon'ble Court deems fit in the interest of justice and equity." - 3 - HC-KAR NC: 2026:KHC:21311 CRL.P No. 5147 of 2026 2. Heard Sri.Anand R.V., learned counsel appearing for the petitioner, Sri.Channappa Erappa, learned HCGP appearing for respondent No.1, Sri.Arjun P.R., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: “We, Shrivatsa, S/o Krishna Iyyangar, aged about 64 years, No.656, 2nd Main Road, 7th Block, Vidyanagar Main Road, Banashankari 3rd Stage, Bangalore – 560 085, and Pratham Ayyangar M R, S/o Ramanujam, aged about 22 years, resident of: No.18, 3rd Cross, Annayappa Block, Kumarapark West, Sheshadripuram, Bengaluru – 560 020, and do hereby solemnly affirm and state on oath as follows: 1. I, the deponent No.1 is the complainant/1st informant/respondent No.2 in the above case. The deponent No.2 is the Accused No.2/petitioner in the above case. We the petitioner and respondent No.2 are well acquainted with the facts and circumstances of the said case. The deponent No.1 is the maternal uncle of petitioner/Accused No.2. 2. We state that the respondent No.1 has registered a case against the petitioner for the offence punishable under Section 305(a) of the BNS Act, 2023 based on the complaint filed by the 2nd respondent on 20.02.2025 and 08.05.2025. 3. We state that, at the intervention of elders and well wishers we have amicably settled the matter among ourselves. The respondent No.2 has no objection to - 4 - HC-KAR NC: 2026:KHC:21311 CRL.P No. 5147 of 2026 compound the offence and to acquit the petitioner from the said case. The respondent No.2 in the course of investigation has secured to his custody release of all the gold jewelleries seized. 4. We state that the matter has been settled amongst ourselves voluntarily without coercion, threat or fraud. As such continuance of the proceedings in C.C.No.21887/2025 would be a futile excise and as such the respondent No.2 has no objection for quashing the charge sheet filed in C.C.No.21887/2025 and quash all further proceedings pursuant thereto. 5. The 1st Informant/2nd Respondent has no grievance remaining against the Accused No.2/Petitioner and has no objection to the compounding offence and acquittal of the Petitioner/ Accused No.2. Wherefore, we pray that this Hon’ble court may be pleased to take this joint affidavit on record and permit the compounding of offense pursuant to the charge sheet and quash all further proceedings filed in C.C.No.21887/2025 pursuant to the FIR filed in Cr.No.0034/2025 for prosecuting the petitioner under section 305(a) of BNS Act, pending on the file of 37th ACMM at Bangalore registered by Giri Nagar Police Station with the permission of this Hon’ble court, in the interest of justice and equity.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the Joint Affidavit and offences not being against the State, I deem it appropriate to accept the Joint Affidavit and terminate the proceedings against the petitioner in the subject petition. - 5 - HC-KAR NC: 2026:KHC:21311 CRL.P No. 5147 of 2026 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.21887/2025 pending before the 37th ACJM, at Bangalore, stands quashed qua the petitioner.
