The instant petition has been filed under Section 447 of the BNSS, 2023 for transfer of O.M.C. No. 123 of 2025 under Section 144 of B.N.S.S., 2023 from the Court of learned Principal Judge, Family Court, Giridih to the Court of Learned Principal Judge, Family Court, Deoghar. 3. Learned counsel for the petitioner submits that both the parties are residing at Deoghar and the maintenance case has deliberately been filed by the opp. party-wife at Giridih Court because her brother resides there. It is further submitted that actually she is not staying at Giridih in connection with any employment or any valid reasons. 4. Learned counsel for the petitioner submits that the petitioner is also a labour class person and it should be convenient for both the parties to prosecute the case before the learned Court at Deoghar. 5. On the other hand, learned counsel for the Opposite Parties has 2026:JHHC:5106 2 T.P.(Crl). No.26 of 2025 vehemently opposed the prayer made by the petitioner and there is no merit in this transfer petition which is fit to be dismissed. 6. Considering the aforesaid submissions of the parties and the grounds taken by the petitioner, it appears expedient to the ends of justice to transfer O.M.C. No. 123 of 2025 under Section 144 of B.N.S.S., 2023 from the Court of learned Principal Judge, Family Court, Giridih to the Court of Learned Principal Judge, Family Court, Deoghar. 7. Accordingly, O.M.C. No. 123 of 2025 is hereby transferred from the Court of learned Principal Judge, Family Court, Giridih to the Court of Learned Principal Judge, Family Court, Deoghar 8.
