THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioner is the proprietor of a business enterprise in her name [M/s. Rajeshwari Traders]. The petitioner is aggrieved by the communication caused by the first respondent [Annexures-H and J]. The first respondent's communication as per Annexure-H which is dated 29.08.2025 is under the provisions of and Insolvency and Bankruptcy Board of India [Information Utilities] Regulations 2017 [for - 4 - HC-KAR NC: 2026:KHC:716 WP No. 27562 of 2025 short, 'the 2017 Regulations] for verification and authentication of the financial assistance availed by her from M/s. Canara Bank, [the second respondent]. These Communications require the petitioner to register, log in, verify and authenticate the details of the loans availed. As can be seen from these Communications, the petitioner can choose the option of 'yes' to authenticate or if there is any discrepancy or dispute, to write suitable remarks in the space earmarked and submit the details. The Communications further read that if the petitioner fails to choose either of the two options, the status of authentication of 'default' shall be marked in terms of 2017 Regulations. This Court, on 16.12.2025, has called upon the second respondent to file documents that evidence the financial assistance extended to the petitioner in the light of the petitioner's case that she is called upon to authenticate the debt without the necessary - 5 - HC-KAR NC: 2026:KHC:716 WP No. 27562 of 2025 details. Sri Vignesh S Shetty, the learned counsel for the second respondent, has placed on record copies of certain documents to buttress the second respondent's case that the petitioner is extended financial assistance and there is a default. Sri U J Havaldar, the learned counsel for the petitioner, and Sri Vignesh S Shetty are heard in the light of these circumstances. This Court must examine whether there is any cause for the present petition and should the petition be disposed of leaving open all questions about the possible disputes between the petitioner and the second respondent to be adjudicated in the proper Forum. As is mentioned above, the Communications extend the petitioner the option of confirming the details as visible once she has registered and logged in along with the option to enter remarks in the case of discrepancy with the details or dispute over the details and only if the petitioner fails to either confirm - 6 - HC-KAR NC: 2026:KHC:716 WP No. 27562 of 2025 choosing the option therefor or entering suitable remarks about the dispute, the status is marked as mentioned therein. This Court finds that with this option being available to the petitioner after she logs in, there is no cause for the present petition. The petition, therefore, stands disposed of accordingly observing that this disposal shall not prejudice the petitioner in any dispute with the second respondent on the loans asserted against her.
