Senthilkumar For R1 & R2 : Mr.M.Mahaboob Athiff, Counsel for State O R D E R This Writ Petition has been filed seeking the issuance of a Writ of Mandamus irecting the respondents 1 and 2 to direct the 3rd and 4th respondents to comply the order of the compensation amount of Rs.7,43,975/- to the petitioner awarded by the Labour Court, Madurai in Pa.E.Sa.Va.No.35/2017 dated 20.05.2019. 2. Heard the learned counsel for the parties. 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. The case of the petitioner is that the petitioner’s husband died while in the course of employment. Consequently, the petitioner filed a claim petition before the Joint Commissioner of Labour under the Employees’ Compensation Act. The Joint Commissioner of Labour, by award dated 20.05.2019, awarded a compensation of Rs.7,43,975/- along with 12% interest in favour of the petitioner. Thereafter, as the awarded amount was not paid, the Joint Commissioner of Labour issued a Recovery Certificate and forwarded the same to the first respondent/District Collector on 21.07.2022 for recovery of the compensation amount. However, till date, despite the issuance of the Recovery Certificate, the award has not been implemented and the compensation amount has not been paid to the petitioner. 5. Considering the limited scope of prayer, this Court directs the first respondent to implement the Recovery Certificate dated 21.07.2022 and recover and disburse the compensation amount to the petitioner, if there is no legal impediment, if not already paid, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 3/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.19645 of 2026 6.
