THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.18189 of 2026 O R D E R: The present Writ Petition is filed questioning the action of the Respondents in refusing to receive and verify the Petitioner’s Educational Qualifications for promotion to the post of Junior Assistant as illegal and arbitrary. 2. The Petitioner was initially appointed as Sweeper on compassionate grounds on 22.01.2014 and thereafter, she was promoted to the post of Office Subordinate. 3. The Petitioner claims to be eligible in the zone of promotion as Junior Assistant. It is stated that the minimum qualification prescribed for Junior Assistant is Intermediate and that the Petitioner had appeared for the Intermediate examination conducted by the A.P. Open School Society, Amaravati, in the month of May, 2026 and had qualified in the examination. Thereupon, the Petitioner had submitted Marks Memo to the Respondents, but the Respondents are not considering the same as the Original Certificate is yet to be issued by the Society. 4. Learned Assistant Government Pleader submits that though the time was extended from time to time, the Petitioner could not produce the Certificates showing the Educational Qualifications and in that context, the case of the petitioner is not being considered for promotion. 5. 6. The Marks Memo of the Petitioner issued by the A.P. Open School Society, Amaravati, dated 19.06.2026, shows that the Petitioner had qualified in intermediate public examination conducted by the said Society. The Certificate insisted by the Respondents is only a consequence of the Marks Memo. 7. In view of the above circumstances, the Writ Petition is disposed of with the consent of both parties with the following directions: i) The Respondents are directed to receive the Marks Memo submitted by the Petitioner dated 19.06.2026 to consider the case of the Petitioner for promotion to the post of Junior Assistant. ii) There shall be no order as to costs.
