THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR
ORAL ORDER
1. In this petition, the petitioner seeks the following reliefs:
"a) Issue a Writ of Certiorari or other appropriate writ or order seeking to set-aside the impugned Lok Adalat award dated 16.03.2024 passed in O.S. HC-KAR NC: 2026:KHC:2899 WP No. 27468 of 2025
3. A perusal of the material on record will indicate that the petitioner is aggrieved by the impugned Lok Adalat award and compromise decree passed in OS No.189/2024 dated 16.03.2024 and 28.03.2024 respectively. In this context, a perusal of the impugned Lok Adalat award and the compromise decree will indicate that the petitioner has not been arrayed as a party to the said suit and she was not a party to the Lok Adalat award or the compromise decree. It follows there from that any order, decree, observation, finding, Lok Adalat award, compromise decree etc., passed in O.S.No.189/2024 to which the petitioner is not a party would evidently not be binding upon the petitioner nor affect her rights and contentions in the suit schedule property in any litigation including O.S.No.8/2019 in which the petitioner is defendant no.1 or O.S.No.442 of 2020 in which the petitioner is the sole defendant. Under these circumstances, without expressing any opinion on the merits/demerits of the rival contentions, I deem it just and appropriate to dispose of this petition by directing that any
judgment, decree, order, Lok Adalat award, compromise decree etc., passed in O.S.No.189/2024 would not be binding upon the petitioner nor would it affect her alleged claim in O.S.No.8/2019 or

O.S.No.442/2020 over the suit schedule property. Liberty is also reserved in favour of both the parties to take recourse to such remedy available in law and to put forth all their claims in any other litigation including OS No.8/2019 and O.S.No.442/2020. Subject to the aforesaid directions and liberty reserved in favour of the parties, the petition stands disposed of.
