Heard Mr. S. Dey, learned counsel appearing for the applicant and also Mr. R. Gurung, learned GA appearing for the State-respondent No.1. There is no appearance on behalf of the respondent No.2 despite service of notice. 2026:MLHC:759
This is an application under Section 5 of the Limitation Act, 1963 for condonation of delay of 43 days in preferring the connected criminal revision petition against the impugned Orders dated 03.02.2026 and 12.05.2026, passed by the learned Special Judge (POCSO), West Garo Hills District in Special (POCSO) Case No.39 of 2025.
The reason for delay has been sufficiently explained at paragraph 3 of the application.
Mr. R. Gurung, learned GA appearing for the State has no objection to the prayer for condonation of delay.
Accordingly, the delay of 43 days in preferring the connected criminal revision petition against the impugned Orders dated 03.02.2026 and 12.05.2026, passed by the learned Special Judge (POCSO), West Garo Hills District is hereby condoned.
Registry is directed to diarize the criminal revision petition and list it for motion.
