04/ 17.03.2026: On repeated calls nobody appeared on behalf of the petitioner. Learned counsel for the State is present.
2. The petitioner is apprehending his arrest in connection with Lalpur P.S. Case No. 47 of 2020, registered under section 379 of I.P.C and thereafter Section 328 of I.P.C was added, pending in the Court of learned Judicial Magistrate, Ist Class, Ranchi.

It has been averred in the anticipatory bail application that the petitioner is innocent and during course of investigation the name of the petitioner has come and the stolen car has not been recovered from the possession of the petitioner. It has also been contended in the petition that petitioner has received notice under section 35 (3) of BNSS, 2023 and reply to the same has also been given through speed post. On these grounds, privilege of anticipatory bail has been sought.

Learned counsel for the State opposes the prayer and submits that the petitioner appears to be a member of gang which is operated by one Surendra Agrawal @ Amit Soni and they are indulged in steeling of car and in view of that the anticipatory bail of the petitioner may kindly be rejected.

In the F.I.R, it is alleged that at about 2.30 P.M. when informant reached at Mahindra Shop, Hazaribag there after 10 minutes some other person gave a bottle of Amul Kool and informant consumed the said drink and after some time the said person told that we have to go to P.W.D. Chowk where somebody was waiting. After few minutes the informant became unconscious and found
( 2026:JHHC:7191 ) himself at Hazribag bus stand and when the informant regained consciousness he found that his car is stolen. It has come in the order of the learned Additional Judicial Commissioner that in para 19 of the supplementary case diary it has come that a gang of thieves are stealing the cars in the area and Amit Soni was one of the member of that gang and petitioner is accomplice of the said gang.
6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail application to the petitioner. Accordingly, prayer for anticipatory bail is hereby rejected.
