The petitioner is before this Court seeking following prayers: (i) Set aside the order dated 13.06.2024 passed in C.C.No.21984/2022 on the file of the Hon'ble XXXVI A.C.M.M at Bengaluru in dismissing the complaint, and restore the same ANNEXURE-E. (ii) Call for records in C.C.No.21984/2022 on the file of the Hon'ble XXXVI A.C.M.M at Bengaluru. 2. The petitioner is the complainant. The respondent is the accused. The transaction between two leads to the complaint before the concerned Court in C.C.No.21984/2022. The concerned Court takes cognizance of the offence and issues summons. The petitioner does not appear before the concerned Court on close to seven occasions. Therefore, the Court left with no choice has dismissed the complaint for its non- prosecution. - 3 - HC-KAR NC: 2026:KHC:5961 CRL.P No. 11037 of 2024 3. The learned counsel for the petitioner submits that if one opportunity is granted, he would appear before the Court and take steps as are necessary in the matter as the amount involved in the case at hand is Rs.1,19,00,464/-. In the light of said submission, I deem it appropriate to grant one opportunity to the petitioner to appear before the Court and take steps in the matter. 4. The matter shall be listed before the concerned Court on 13.02.2026. The petitioner shall appear before the Court on the said day. In the event the petitioner would again repeat the same conduct, it is open to the concerned Court to pass necessary orders in accordance with law. The petition stands disposed accordingly.
