MS.R.S.INDIRA, GOVT.ADVOCATE (CRL.SIDE) ORDER The petitioner, who apprehends arrest for the alleged offences under Sections 19(c) (v), 25(1) Fertiliser Control Order-1985 read with Section 7(1) a(ii) of EC Act, 1955 in Crime No.220 of 2026 on the file of the respondent police, seeks anticipatory bail. https://www.mhc.tn.gov.in/judis

2. The case of the prosecution is that the petitioner is found in illegal possession of 1665 kgs of Urea. It is alleged that there are five accused in this case, they were collecting the Urea from the farmers and illegally kept it at godown. On inspection, apart from the above, large quantity Urea were found and they got red handed . Hence the case. 3. The learned counsel for the petitioner would submit that the petitioner is the owner of the vehicle and he owns two lorries. It is submitted that the petitioner has been implicated in the present case alleging illegal transportation of subsidised urea from Pattukottai to Coimbatore. He further submitted that he is innocent person and he is no way connected to the case as alleged by the prosecution. There are three accused in the present case. 3. The learned Government Advocate (Crl. Side) strongly opposed the bail application on the ground that the petitioner had illegally transported 19 tonnes of subsidised urea, which is intended for agricultural operations and the benefit of poor farmers. 4. This Court has carefully considered the submissions made by the learned Government Advocate (Crl. Side).

The learned Government Advocate further submitted that the investigation is at a nascent stage. 5. Considering the nature and gravity of the allegations, the impact of the offence on the farming community, and the nauseant stage of investigation, this Court is of the considered view that the petitioner does not deserve the discretionary relief of bail at this stage. 6.
