The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of regular bail, as he has been arrested in connection with Crime No. 192/2024, registered at Police Station Koni Distt. Bilaspur (CG) for the offence punishable under AKHILESH KUMAR DEWANGAN Digitally signed by AKHILESH KUMAR DEWANGAN 2 Sections 307, 120-B, 201 and 34 of the Indian Penal Code (IPC). 2. The prosecution story in brief, is that on 30.05.2024 at about 11:30 PM, the injured Lavkesh Rao Bhosale @ Lavi was sitting at Glory Dhaba when an unknown person assaulted him with a sharp-edged weapon on his face with the intention to kill him. During investigation, it was revealed that the present applicant Virendra Kumar Pardhi @ Veera, along with co-accused persons, had hatched a criminal conspiracy, came to Bilaspur, identified the victim at the dhaba, and the applicant, being the main assailant, took out a knife from the motorcycle and inflicted injuries on the face and neck of the victim and thereafter fled from the spot. Accordingly, offence under Sections 307, 120-B, 201 and 34 of IPC was registered and the matter is under trial. Hence, the bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submit that two of the identically situated co-accused persons, namely, Roshan Starly and Ankit Chauhan have already been granted bail by this Court vide orders dated 08.08.2025 and 10.09.2025 in MCRC Nos.4633 of 2025 and 7226 of 2025, respectively. He also submits that charge-sheet has been filed and applicant is in jail since 27.06.2025, the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicant. 3 4. On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. He further submits that the main assailant, who inflicted injuries upon the victim by means of a sharp-edged weapon, as a result of which the victim sustained grievous injuries and while granting bail to the said co- accused persons, the Court has specifically distinguished the case of the said co-accused persons from that of the present applicant. He further submits that the incident pertains to the year 2024, whereas the applicant surrendered after a lapse of about one year and was arrested on 27.06.2025, therefore, the applicant is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. From perusal of the record, it transpires that the present applicant/accused, Virendra Kumar Pardhi @ Veera is alleged to be the main assailant, who, in furtherance of a pre-planned conspiracy with co-accused persons, inflicted grievous injuries upon the victim by means of a sharp-edged weapon on his face and neck with the intention to kill him. It also emerges that co- accused persons have been granted bail on the ground that their cases were specifically distinguished from that of the present applicant as the present applicant is main assailant. Moreover, the incident is of the year 2024, the applicant was absconded and 4 was arrested on 27.06.2025 after a lapse of about one year, so there is every likelihood the he may abscond again, which would adversely affect and hamper the trial. In view of the nature and gravity of the allegations, the role attributed to the present applicant and fact that the applicant had absconded earlier, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant-Virendra Kumar Pardhi @ Vira, involved in Crime No. 192/2024, registered at Police Station Koni Distt. Bilaspur (CG) for the offence punishable under Sections 307, 120-B, 201 and 34 of the Indian Penal Code (IPC), is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and concluded the trial expeditiously. 9.
