For Petitioner(s): Mr.G.Vinodhkumar For Respondent(s): Mr.S.Yogaraja Sekar, Government Advocate (Criminal Side ) ORDER The petitioner, who was arrested and remanded to judicial custody on 03.05.2026 for the alleged offences under Sections Girl Missing @ 137 (1) (b) of BNS Act and Section 5 (l), 6 and 17 of POCSO Act r/w 9, 10 of Child Marriage Act, in Crime No.150 of 2026 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the case was initially registered as a Girl Missing case. It is further alleged that the petitioner tied a thali on the victim girl, took her to various places and committed forcible penetrative sexual assault against her. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 03.05.2026. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police produced the victim’s statement recorded under Section 183 of the BNSS, and submitted that the petitioner is approximately thirty-six years old and the victim is approximately sixteen years old. A perusal of the statement recorded under Section 183 BNSS, reveals serious allegations of sexual assault against the minor victim Hence, he strongly opposed for grant of bail to the petitioner. 5.In view of the submissions made by the learned Government Advocate (Criminal side) and a perusal of the statement recorded under Section 183 of the BNSS, which clearly demonstrates serious allegations of forcible penetrative sexual assault against the petitioner, this Court is of the firm view that the https://www.mhc.tn.gov.in/judis CRL OP No. 17725 of 2026 __________ Page3 of 4 petitioner is not entitled for bail.
