ORDER This Criminal Original petition is filed with a direction to set aside to the
order dated 20.04.2026 made in C.M.P.No.01 of 2026.
2. Upon hearing the learned counsel for the petitioner and perusing the material records of the case the application has been filed to re-call P.W.1 for https://www.mhc.tn.gov.in/judis
CRL OP No. 17375 of 2026 __________ Page2 of 4 cross examination and the same is dismissed by the Trial Court. It can been seen that the maintenance case is of the year 2023. The P.W.1 was examined in chief on 12.09.2025 and the matter was posted for cross examination of P.W-1 on 03.10.2025,23.10.2025,20.11.2025,24.11.2025, 12.12.2025 and 05.01.2026. On all the occasions it was seen that P.W.1 was present in the Court and the petitioner did not cross examine. Thereafter, when the matter is closed now the application is filed to recall for cross examination of P.W.1. It is not the case where the petitioner is denying the relationship.
3. In view thereof with reference to quantum it will always be open for the petitioner to let in evidence by examining himself and no serious prejudice would be caused. When the respondent wife has approached the Court, the least that is expected is that she should not be further harassed. The case is pending from the year 2023 and the Trial Court rightly considered the overall circumstances and dismissed the petition.
