The case of the prosecution is that on 29.05.2026 at about 1.00 P.M., the petitioner was driving the vehicle in a rash and negligent manner. When the same was questioned by the defacto complainant, the petitioner along with other accused assaulted and threatened the defacto complainant and also abused her in a filthy language. Further, 7 grams of gold chain and a mobile phone were also stolen by the accused persons. 3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and has not committed any offence as alleged by the prosecution. He would further submit that a false case has been foisted against the petitioner. He would submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays for the grant of anticipatory bail. 4.The learned Government Advocate (Crl. Side) for the respondent reiterated the prosecution case and submitted that 7 grams of gold chain and a mobile phone are yet to be recovered from the petitioner. She would further submit that the co-accused A3 and A5 were arrested and released on bail. The petitioner has no previous cases. However, she opposed for grant of anticipatory bail to the petitioner. 2/5 https://www.mhc.tn.gov.in/judis 5.From the submissions made by the learned Government Advocate, it is seen that the co-accused, A3 and A5, were arrested and released on bail on an own bond and that there is no previous case pending against the petitioner. In view of the above, this Court is of the firm view that the custodial interrogation of the petitioner is not required. Hence, this Court is inclined to enlarge the petitioner on anticipatory bail with certain condition: 6. Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen (15) days from the date on which the order copy is made ready, before the learned Additional Mahila Court, Perambalur, on condition that the petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, each for a like sum, to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further conditions that: [a] If the petitioner fails to surrender before the concerned learned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled; [b] The sureties shall affix their photographs and left thumb impression in the application for suretyship (Judicial Form No.46 annexed to ‘The Criminal Rules of Practice, 2019]’.
