Side) for R1 to R4 ORDER The Criminal Original Petition is filed to transfer the investigation in Crime No.434 of 2025 dated 27.12.2025 on the file of the Inspector of Police C-2 Elephant Gate Police Station, Chennai. 2. The grievance of the petitioner is that when the petitioner despatched valuables such as gold, silver and diamonds through the regular carrier, the same was missing and hence, a case was registered in Crime No.434 of 2025 for the alleged offence under Section 316(2) of BNS. Even though the case is registered and four of the five accused have been arrested, till date, no recovery is made. In a case of missing valuables, the primary purpose of lodging complaint is only to retrieve the gold, silver and diamonds. The same is not being done. Therefore, the petitioner seeks to transfer the case. 3. When the matter came up for hearing, the learned Government Advocate (Crl. Side) would submit that this case involves the offence being committed by the persons associated in Bengaluru. Already, four of the five accused have been nabbed. The 5th accused is said to be in possession of the Jewels etc. and he is still elusive. In reply thereof, the learned counsel for the petitioner would submit that it is only the CBCID, that has the wherewithal to deal with these kinds of cases and have the technical experts, especially, when the accused are interested. 5. I have considered the rival submissions made on either side and perused the material records of the case. 6. Normally, if the value of the stolen / missing articles is more than Rs.1,00,00,000/-, the investigation by standing order gets transferred to the CBCID. In this case, it is slightly lesser i.e., as on December 2025, the value is said to be Rs.90,00,000/-. As a matter of fact, considering the subsequent price rise, the value of the goods have also crossed Rs.1,00,00,000/-. Therefore, considering the same and considering the facts pleaded by the counsel for the petitioner, I am of the view that in the interest of better investigation of the case, the investigation of Crime No. 434 of 2025 on the file of the 3rd respondent Police be transferred to the file of the 4th respondent. Due orders in this regard shall be issued by the 2nd respondent within one week from the date of receipt of the web copy of the order.
