He further submitted that the case was initially registered under Section 5 (m) of the POCSO Act, which was later altered to Sections 9 (u), 9 (m) r/w Section 10 of the POCSO Act. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and produced the victim’s statement recorded under Section 183 of the BNSS, which contains serious allegations of sexual assault. He further submitted that the petitioner is approximately thirty-four years old whereas the victim is approximately seven years old. He further contended that since the petitioner is a tenant, enlarging him on bail would create a fear psychosis in the mind of the seven years old victim. Hence, he opposed for grant of bail to the petitioner. 5.In view of the submissions made by the learned Government Advocate (Criminal side) and upon a perusal of the statement recorded under Section 183 of the BNSS, which clearly demonstrates serious allegations of sexual assault against the petitioner, this Court is of the firm view that this is not an https://www.mhc.tn.gov.in/judis CRL OP No. 17774 of 2026 __________ Page3 of 4 appropriate stage to enlarge the petitioner on bail.
