Petitioner Versus S.Ravikumar .. Respondents Prayer : Criminal Original Petition filed under Section 528 of BNSS, 2023, to call for the records pertaining to the impugned proceedings pending on the file of the learned Judicial Magistrate, Sirkali in S.T.C.No.460 of 2019 filed by the respondent herein and quash the same. For Petitioner : Mr.S.Diwakar ORDER When the matter is taken up for hearing, it is represented by the learned Counsel for the petitioner that in the Trial Court’s records itself, the Summary Trial Case number is wrongly mentioned as ‘S.T.C.No.460 of 2019’ instead of ‘S.T.C.No.259 of 2019’ and accordingly, the same mistake is carried on even in this Court’s records also. Therefore, the 1/4 https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis Crl.O.P.No.18406 of 2026 Summary Trial Case number shall be treated as ‘S.T.C.No.259 of 2019’. 2. The prayer made in this Criminal Original Petition is to quash the private complaint in S.T.C.No.259 of 2019 pending on the file of the learned Judicial Magistrate, Sirkali. 3. The above case is a private complaint complaining an offence under Section 138 of the Negotiable Instruments Act, 1881. 4. The learned Counsel for the petitioner would submit that from the records, it can be seen that the petitioner had earlier complained that the cheque is lost. One year after the complaint of the petitioner, the cheque is filled up and exercised by the complainant. 5. I have considered the said submissions made by the learned Counsel for the petitioner. 6. The case is pending from the year 2019 and therefore, this quash application will not be entertained in the year 2026. Further, the submission made is factual in nature. The petitioner can very well raise all 2/4 https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis Crl.O.P.No.18406 of 2026 these issues before the Trial Court and it is for the Trial Court to consider the same. 7.
