Order No. 03/ Dated: 09th April, 2026
1. Heard learned counsel for the parties.
2. Apprehending their arrest in connection with Pratappur P.S. Case No. 75 of 2012 registered under Sections 420 & 406 of the Indian Penal Code, the petitioners have moved this Court for grant of privilege of anticipatory bail.
3.
Learned counsel for the petitioners submits that earlier anticipatory bail application of the petitioners was rejected by this Court in A.B.A. No. 9424 of 2022. It is further submitted that in respect of money alleged to be embezzled without completing the work, has been resolved and work has already been constructed. This finds mention in the impugned order passed by learned Sessions Judge, Chatra in A.B.P. No. 1491 of 2025 dated 05.12.2025. Most of the co-accused persons have already been granted anticipatory bail vide A.B.A. No. 2114 of 2019, A.B.A. No. 11672 of 2022, A.B.A. No. 893 of 2023 and A.B.A. No. 659 of 2023 by different coordinated benches of this Court. Therefore, petitioners may also be admitted to anticipatory bail.
4. Learned P.P. has opposed the prayer for anticipatory bail of the petitioners and submitted that there is no fresh ground to entertain this anticipatory bail application.
5. Considering the facts and circumstances, I do not find any fresh and reasonable ground to grant anticipatory bail to the petitioners who are prime accused persons but so far as work has been constructed, the

petitioners are directed to appear before the concerned trial Court and seek regular bail which shall be considered on merits in the facts pleaded above by the learned counsel for the petitioners.
6. With the aforesaid observation, this anticipatory application is
disposed of.
