ORDER This Civil Revision Petition has been filed challenging the impugned
order dated 06.01.2025 passed by the IV Additional District Munsif, Salem in I.A.No.4 of 2004 in O.S.No.76 of 2019. In the aforesaid order, the application filed by the petitioner who is the plaintiff in the suit seeking to examine the Village Administrative Officer as a witness to the suit and mark the death ceremony certificate has been dismissed. The Trial Court while dismissing the application has given the following reasons: (a) The petitioner’s possession over the suit property cannot be proved through the examination of the witness. (b) The witness summoned is an official witness who is having more pressure of work. (c) The official witnesses cannot be unnecessarily dragged to the Court, in respect of a dispute between two individuals. (d) It is not necessary to summon the Village Administrative Officer to depose the evidence.
2. The petitioner being the plaintiff in the suit has to discharge his initial burden of proving the suit claim through his oral and documentary evidence. He cannot collect evidence through the examination of the Village Administrative https://www.mhc.tn.gov.in/judis
