THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE B M SHYAM PRASAD
ORAL ORDER
The petitioner, who asserts possession of 3 acres of land in Sy.No.64/P8-P1 of Vadandahalli Village, Robertsonpet Hobli, Mallahalli Grama Panchayathi, Bangarpet Taluk, Kolar District [the subject property] , has sought for directions to the jurisdictional police to protect his possession.
The learned counsel for the petitioner submits that the petitioner may have failed in a suit for declaration of title and permanent injunction in O.S.No.183/2016 with the suit being dismissed and the dismissal being confirmed in a regular appeal, but the petitioner's second appeal in R.S.A.No.1270/2025 is pending consideration. The
learned counsel also submits that certain persons are

also attempting to dispossess the petitioner from the subject property asserting to claim under the original grantee have initiated proceedings under the Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978 and there are orders for restoration, but the petitioner has filed the petition in W.P.No.22222/2025 and this Court has granted interim order for maintenance of Status Quo which is continued from time to time. The learned counsel contends that notwithstanding these circumstances, the petitioner fears dispossession and therefore there must be direction to the police to intervene.
This Court must observe that if there is an
order of Status Quo by this Court, that must prevail, and in any event, if there is an order for restoration and the property has to be restored, it has to be after drawing up of necessary procedure. In the circumstances, there would be no cause for

directions to the respondent police. This petition only leads to multiplicity of proceedings. The petitioner must file an application, if there is occasion for the same, in the pending proceedings.
Hence, subject to all just exceptions, the petition stands disposed of.
