CRL OP No. 17805 of 2026 __________ Page2 of 4 ORDER The Petitioner seeks to transfer the investigation in Crime No.123 of 2026 from the file of the 3rd respondent to any other agency. 2. The learned counsel for the petitioner would submit that the 4th respondent trespassed and put up a house on a plot originally assigned to the petitioner’s father. The petitioner had lodged a complaint, but no action was taken. On the contrary, the present case was registered on a false complaint lodged against the petitioner. Therefore, there is a biased attitude on the part of the Investigating Officer. 3. Per contra, the learned Government Advocate (Criminal Side) would submit that there is a boundary dispute between the parties. Since the complaint was made about threats and the petitioner trying to trespass into the property, the FIR was registered and the same is under investigation. 4. Considering the submissions made on behalf of the 3rd Respondent and considering the apprehension expressed on behalf of the petitioner, this Criminal Original Petition is disposed of on the following terms: (i) The 3rd Respondent shall continue the investigation in a fair and transparent manner and file the final report as expeditiously as possible, in any https://www.mhc.tn.gov.in/judis
