D/L – 76 15/10/2026 Court No.42 S.Kundu WPA 11568 of 2021 Bhuvan Bacher & Ors. Vs. The Union of India & Ors. Mr. Sudarshan Agarwal Ms. Debajana Paul …for the respondent no.2. 1. Learned counsel for the respondent no. 2, in compliance of the order dated 12.08.2026, has filed affidavit-of- service of notice intimating the petitioners regarding the pendency of the present revisional application before this Court. Let it be taken on record. 2. It appears therefrom that the petitioner no. 1, has replied to the said intimation by way of an e-mail stating ‘I have not filed a case or lodged a complaint in any Court..’. 3. It also appears that despite service of notice upon the learned advocate-on-record for the petitioners, none appears to represent the petitioners. 4. None appears on behalf of the respondent no. 5. Service upon the other respondents is also not complete. 5. Considering the reply of the petitioner no.1, absence of his learned advocate-on-record as well as the non- appearance of the respondent no. 5 and incomplete service upon the other respondents, I am of the opinion that this matter deserves to be dismissed for non- prosecution. 2 6. WPA 11568 of 2021 is accordingly dismissed for non- prosecution. 7. There shall be no order as to costs. 8. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities. (Uday Kumar, J.)
