The petitioners are apprehending their arrest in connection with Dhalbhumgarh P.S. Case No.51 of 2025, for offence registered under section 303(2), 317(2), 3(5) of BNS, 2023, Sections 4 and 21 of Jharkhand Mines and Minerals (Development and Regulation) Act, 1957, Rule 54 of Jharkhand Mines and Minerals Concessions Rules, 2004 and Rules, 7,9 and 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned A.C.M.J., at Ghatshila. 3. Learned counsel for the petitioners submits that the petitioners happened to be drivers of two different Hywa trucks and 600 cft sand was loaded on each of the Hywa truck. She further submits that the petitioners are having no criminal antecedent as 2026:JHHC:2861 2 disclosed in paragraph no.14 of the petition and the petitioners have also complied to the notice issued under section 35(3) of the BNSS, 2023. 4. Learned State counsel opposes prayer and submits that illegally the sand in question was loaded on the said Hywa trucks. 5. Considering that the petitioners have complied to the notice issued under section 35(3) of BNSS, 2023, and in that view of the matter, both the petitioners, above named, are directed to surrender before learned court within two weeks from today and learned court shall release both the petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper. 6.
