Court No. 652
D.Hira
WPA 29617 of 2026
Sunil Shaw & Anr. Vs. CESC Limited & Ors.
Mr. Indranil Halder, Ms. Neha Singh. … for the petitioners
1. Affidavit-of-service filed in Court today is taken on record.
2. In the instant writ petition, the grievance inter alia, of the petitioners is that within the premises of the property purchased by the petitioners in the year 2022, there are meters installed of the adjacent shop owners, who are rank outsiders and no way connected with the premises of the petitioners.
3. This Court finds that the petitioners being conscious buyers purchased the property as it is, though the petitioners have stated that existence of meters of the outsiders within the premises is a fact known to him only after purchase of the property.
4. Upon carefully considering the nature of the instant case, the Court finds involvement of no public element in the instant case, rather the dispute if any between the parties appears to be private in nature. The element of the respondent’s involvement in violation of rights of the writ petitioner is unavailable in the instant case.
5. Accordingly, this Court finds that the present writ petition not to be maintainable before this Court, at least at the present moment.
