Case no. 280 of 2025 under Sections 7, 10, 11, 19 (b) & 25 of the Guardians and Wards Act, 1980 from the Court of the Learned Additional District Judge, Fast Track Court-II, Howrah to the Court of Learned District Judge, Cooch Behar, District – Cooch Behar. 3. On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that the Misc. Case no. 280 of 2025 has 2 2 been filed in the Court of Learned Additional District Judge, Fast Track Court-II, Howrah by the husband/opposite party herein. 4. The petitioner/wife herein is residing at VTC Cooch Behar-I, P. O. – Cooch Behar, Sub-District – Cooch Behar-I, District – Cooch Behar, PIN 736 101. 5. On hearing the learned counsels for both the parties and also on considering that the ordinary place of residence of the child is at Cooch Behar, this Court relying upon its order dated 27.03.2026 passed in CO 4128 of 2024, Shantilal Sharma v. Susant Vyas @ Sushanta Vyas & Ors. directs that Misc. Case no. 280 of 2025 be withdrawn from the Court of Learned Additional District Judge, Fast Track Court-II, Howrah and be transferred to the Court of Learned District Judge, Cooch Behar, District – Cooch Behar. 6. The Learned District Judge, Cooch Behar, District – Cooch Behar shall proceed with the suit in accordance with law with due notice upon both the parties. 7. Keeping in mind the case of the opposite party herein, the Learned District Judge, Cooch Behar, District 3 3 – Cooch Behar shall be at liberty to permit the opposite party to appear virtually, if such prayer is made. 8.
