Mr. Gaurav Kandpal, learned counsel for the petitioner. 2. Mr. N.K. Papnoi, learned Standing Counsel for the State of Uttarakhand. 3. Mr. Shailendra Nauriyal, learned counsel for the respondent – Selecting Body. 4. According to petitioner, his name was included in the provisional recommendation list issued by Uttarakhand Subordinate Service Selection Commission for the post of Workshop Instructor, however, in the final recommendation list, petitioner’s name was arbitrarily excluded. 5. By means of this writ petition, petitioner has sought the following reliefs: - (i) Issue a writ, order or direction in the nature of mandamus directing the Respondent selecting body UKSSSC to revise the Provisional Recommendation List dated 10.11.2023 of the post of Workshop Instructor (Branch 2- Mechanical) and include the name of the Petitioner as per his merit position of the written examination in EWS Category, inasmuch as the name of the Petitioner was included in the Provisional Recommendation List dated 25.10.2023. (ii) Issue a writ, order or direction in the in the nature of a writ of mandamus directing the Selection Commission to consider and decide the petitioner’s representation dated 27.01.2026 in a time-bound manner, within such period as may be fixed by this Hon’ble 2026:UHC:1435 Court. (Annexure NO. 10) 6. Learned counsel for the Selecting Body submits that the advertisement for the aforesaid post was issued on 05.10.2021, and as per his instructions, the selection process is over. He, however, submits that petitioner can be permitted to make representation to the Competent Authority. 7. Learned counsel for the petitioner submits that petitioner has already made a representation to the Competent Authority, which is on record as Annexure 10 to the writ petition. 8. Accordingly, the writ petition is disposed of with a direction to Secretary, Uttarakhand Subordinate Service Selection Commission to take decision on pending representation, as per law, within four weeks from the date of presentation of certified copy of this order.
