1. The instant bail application has been filed under Section 483 of BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No.112/2025 registered at Police Station Dug, District Jhalawar for the offence(s) under Sections 103(1), 3(5) of BNS and the learned Trial Court amidst the offences under Sections 103(1), 3(5), 249 of BNS and under Sections 3/25, 5/25, 3/27 of the Arms Act, dismissed the bail application before it.

Learned counsel for the accused-applicant submitted that the applicant is sole bread earner of the family and he is behind the bars ever since 28.04.2025. It is submitted that the applicant was arrested immediately after registration of FIR i.e. on 25.04.2025.
[2026:RJ-JP:11201] (2 of 2) [CRLMB-16086/2025] It is also submitted that in the FIR, the allegation is for commis- sion of offences under Sections 103(1) and 3/5 of BNS, and the present applicant is not named therein. It is further submitted that the applicant is not having any criminal antecedents. It is submit- ted that the two witnesses i.e. Deepak and Iswar Khan have turned hostile during the course of trial and that the primary attri- bution qua offence is towards Sohail Khan vis-a-vis recovery of pistol/gun, by which the death is caused.
3. Per contra, learned Public Prosecutor has vehemently op- posed the bail application. It is submitted that a motorcycle has been recovered at the instance of the applicant.

Considering the arguments advanced by the counsel for the parties; that the applicant is not having any criminal antecedents and he is not named in the FIR; that the case of the applicant is distinguishable from Sohail Khan’s case and other co-accused and looking to the overall facts and circumstances of the case and ma- terial on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the ac- cused-applicant and enlarge him on bail.

Accordingly, the bail application under Section 483 of BNSS is allowed and it is ordered that accused-applicant Farook Khan S/o Ayyub Khan shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
