JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.2 under Section 483 of BNSS praying to grant bail in C.C.No.4479/2016 arising out of Crime No.67/2015 of Tumkur Rural Police Station, pending on the file of I Additional Civil Judge and JMFC, Tumkuru, registered for offences punishable under Sections 504, 323, 324, 114, 307 r/w Section 34 of IPC. 2. Heard the learned counsel for petitioner and learned Additional SPP for respondent/State. 3. The petitioner has been granted bail by order dated 27.04.2015 and he has been released on 13.05.2015. Thereafter he remained absent. NBW has been issued against him and he has been secured by executing NBW on 15.08.2025 and since then he is in judicial custody. It is submitted that the petitioner was in - 3 - HC-KAR NC: 2026:KHC:11238 CRL.P No. 13609 of 2025 judicial custody in Crime No.131/2018 and therefore, he could not appear in the present case. The petitioner has now deposited Rs.50,000/- towards forfeited bond amount and produced a receipt dated 17.02.2026 issued by District and Sessions Court, Tumkur. The petitioner could not appear in the case for some dates and also on some other dates as he was in judicial custody in some other crime. The petitioner has now undertaken to appear before the trial Court and co-operate for speedy trial. 4. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. In the result, the following: ORDER Petition is allowed. Petitioner is granted bail in C.C.No.4479/2016 arising out of Crime No.67/2015 of Tumkur Rural Police Station, pending on the file of I Additional Civil Judge and JMFC, Tumkuru, subject to following conditions: - 4 - HC-KAR NC: 2026:KHC:11238 CRL.P No. 13609 of 2025 (i) Petitioner shall execute a bail bond for a sum of Rs.1,00,000/- with one surety for the like-sum to the satisfaction of the jurisdictional Court. (ii) Petitioner shall not tamper the prosecution witnesses either directly or indirectly. (iii) Petitioner shall attend to the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
