At the outset, learned counsel for the parties submit that the issue involved in this writ petition was considered and decided by the Single Bench of this Court in WPS/3346/2020 (Pankaj Kumar Tiwari v. State of Chhattisgarh and Others) vide order dated 12/03/2025, however, in the writ appeal preferred by the Zila Sahkari Kendriya Bank Maryadit being WA/307/2025, the Division Bench of this Court, vide judgment dated 08/05/2025, partly allowed the order passed by learned 3 Single Judge in WPS/3346/2020 and set aside the order to the extent of the direction to reinstate the services of the petitioner without backwages. Thereafter, against the judgment dated 08/05/2025 passed by the Division Bench of this Court in WA/307/2025, the petitioner therein preferred an SLP bearing No. 30077/2025, however, the same stood dismissed by the Supreme Court, as such, the judgment passed by the Division Bench of this Court in WA/307/2025 has become final. 2. At this stage, it would be appropriate to notice the concluding paragraphs of judgment dated 08/05/2025 passed by this Court in WA/307/2025, which states as under :- “15. For the foregoing reasons, the writ appeal is partly allowed and the impugned order dated 12.03.2025 passed by the learned Single Judge so far as it relates to the direction to respondent authorities to reinstate the services of the petitioner without back wages is concerned, the same is set aside. 16. Further considering the fact that writ petitioner / respondent No. 1 and other similarly situated writ petitioner, who are 29 in number, are not in service since, 2015, we direct the appellants herein/respondent Nos. 6 & 7 therein to conclude the fresh proceedings, as has been ordered by the learned Single Judge, as early as possible preferably within a period of three months from the date of receipt of a copy of this order.” 3. In that view of the matter, this writ petition stands disposed of in terms of paragraph 16 of judgment dated 4 08/05/2025 passed by this Court in WA/307/2025, as reproduced herein-above.
