Mr.Abhishek Sati, learned counsel for the petitioner. 2. Mr. S.S. Chaudhary, learned Standing Counsel for the State of Uttarakhand. 3. Petitioner participated in a selection for the post of Assistant Teacher, Government Primary School in District Bageshwar. Since petitioner’s name did not figure in the list of successful candidate, therefore, he has approached this Court seeking the following reliefs:- (i) To issue a writ, order or direction in the nature of Mandamus directing the Respondents to re- categorize the Petitioner in the Science category against the post of Assistant Teacher Primary. (ii) To issue a writ, order or direction in the nature of Mandamus directing the Respondents to give appointment to the petitioner on the post of Assistant Teacher Primary with consequential benefits. 4. Learned counsel for the petitioner had contended that petitioner’s score of quality point marks was 66.06 marks, which was more than the marks scored by the last selected candidate in Science Stream. 5. Learned State Counsel was asked to get instructions in the matter. Today, on instructions, learned State Counsel submits that petitioner passed Bachelor’s Course with Hindi Literature, History and Sociology subjects, therefore, his claim 2026:UHC:1551 for appointment can be considered only against vacancies in Art Stream and his claim for appointment against post available in Science Stream is unfounded. 6. Learned State Counsel has drawn attention of this Court to petitioner’s mark-sheet of B.A. Part-III examination, which also indicates that petitioner passed Graduation with Hindi Literature, History and Sociology subjects. 7. In such view of the matter, the prayer made by petitioner to re- categorise him and consider him for appointment in Science Category cannot be granted. 8. Accordingly, the writ petition fails and is dismissed.
