2. The case of the prosecution is that the Village Administrative Officer had preferred the complaint alleging that on 21.05.2026, he had received an information that a male aged about 35 years was found dead near Aagaravaram Mariyamman Koil Street. The deceased was found with bloodstains. Hence the present FIR was registered arraying the petitioner herein as A6. 3. The learned counsel for the petitioner would submit that the petitioner is a railway employee and residing in the Railway Quarters. On 20.05.2026 at 11.00 PM, while the petitioner and his family members were getting ready for the family tour, the petitioner’s daughter standing in front of the house. At that time, an unknown person in a drunken state ran towards the petitioner’s daughter shouting and throwing stones at her. She got afraid and ran inside the house and informed her the petitioner. Thereafter, the unknown person ran and hide behind the house of the petitioner and the petitioner found the unknown person. At that time, A4 and A5 have came there and instructed the petitioner to hand him over to the railway police. The petitioner informed the railway police about the incident through his mobile phone and thereafter, departed to the family tour and returned only on 24.05.2026. After returning from the trip, he came to know that the unknown person had died and the FIR has been registered arraying him as A6. https://www.mhc.tn.gov.in/judis

The learned counsel for the petitioner would further submit that based on the confession of the co-accused, the petitioner has been arrayed as an accused in this case and the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner. 5. Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that this is a case of murder and the investigation is at a nascent stage and all the co- accused are still in custody. Hence, she opposed to grant anticipatory bail to the petitioner. 6. Considering the submissions made by the learned Government Advocate that the investigation is at nascent stage, this Court is of the firm view that it is not desirable to enlarge the petitioner on anticipatory bail.
