------ 02/ 06th April, 2026
1. Heard the parties. 2. The prayer of the petitioner is that the respondent-bank be directed not to disburse the amount in favour of the nominee till the Succession Certificate Case is decided. 3. Admittedly, the petitioner is not the nominee in respect of Account No.09932040000570 maintained by the Punjab National Bank, Ranchi Women’s College Branch in the name of deceased-Dr. Kamleshwar. Admittedly, there is a nomination and respondent No.5 is the nominee. 4. There is no doubt about the proposition of law that the nomination can be made, not only in the name of successor, but also in favour of any other person. Further it is also settled proposition that the person who is nominated is only entitled to

receive the money. If a claim is made by the legal heirs, the nominee has to disburse the same, as per the law of succession. 5. In this case, admittedly, the petitioner is not the nominee and the nominee is respondent No.5.
Since the sole account holder is died and an application has been filed by the nominee for receiving the amount, the bank is in the process of disbursing the same in favour of the nominee. There is no illegality committed by the bank. 6. Admittedly there is no Succession Certificate in favour of the petitioner as on date and in fact as per the submission made by the counsel, as on date, no such application before any competent Court has been filed. Thus, no fault can be found with the bank if the amount is disbursed in favour of the nominee. 7. No relief can be granted to the petitioner, in this application, accordingly, this writ petition is dismissed. (ANANDA SEN, J.)
