THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 3 - HC-KAR NC: 2026:KHC:2342 WP No. 23619 of 2023 CORAM: HON'BLE MR. JUSTICE ASHOK S.KINAGI ORAL ORDER 1. The petitioner has filed this writ petition seeking for a mandamus directing respondent No.2 to consider the representation dated 06.07.2022 to permit the petitioner to resubmit his thesis. The respondents have not passed any order on the said representation. Hence, this writ petition. 2. Respondent No.3 has filed a statement of objections contending that the writ petition is liable to be dismissed on the ground of delay and laches. It is stated that the petitioner has submitted his thesis on 31.12.2002 and the respondent-University had called upon the petitioner to submit the revised thesis on 14.08.2004. The maximum period provided under the Regulations is six years (5+1). In the instant case, the petitioner is seeking for consideration of his representation dated 06.07.2022 and for - 4 - HC-KAR NC: 2026:KHC:2342 WP No. 23619 of 2023 resubmission of thesis nearly after 19 years. Hence, prays to dismiss the writ petition. 3. Heard the learned counsel for the petitioner and the learned counsel for respondent No.3. 4. The learned counsel for the petitioner submits that the petitioner has submitted an application for seeking permission to re-submit his thesis. Respondent No.3 has not passed any order on the said representation. Hence, on these grounds, he prays to allow the writ petition. 5. Per contra, learned counsel for the respondents submits that the petitioner has submitted the thesis on 31.12.2002 and the respondent-University had called upon the petitioner to submit the revised thesis on 14.08.2004. He submits that the said representation submitted by the petitioner is after 19 years. Hence, on the ground of delay and laches, the petition is liable to be dismissed. - 5 - HC-KAR NC: 2026:KHC:2342 WP No. 23619 of 2023 6. Perused the records and considered the submissions of the learned counsel for the parties. 7. It is an undisputed fact that the petitioner got provisionally registered for Ph.D. course and he submitted a thesis on 31.12.2002 and the respondent-University called upon the petitioner to submit his revised thesis on 14.08.2004. 8. Regulation No.2.7 provides for the maximum period, according to which, it is six years. Admittedly, in the instant case, the petitioner has submitted a representation on 06.07.2022 i.e., after 6 years. 9. Thus, the petitioner has not shown a sufficient cause for submitting a representation after 19 years from the 14.08.2004, vide Annexure ‘D’. As such, the representation submitted by the petitioner is belated. Hence, the respondents have rightly declined to consider the representation of the petitioner. - 6 - HC-KAR NC: 2026:KHC:2342 WP No. 23619 of 2023 10. Hence, I do not find any grounds to entertain the writ petition. Accordingly, the writ petition is dismissed. Sd/- (ASHOK S.KINAGI) JUDGE RK CT:KHV List No.: 1 Sl No.: 32
