Heard the parties.
The petitioner has been made accused in connection with S.T. Case No.576 of 2025 arising out of Mandar P.S. Case No.57 of 2025 registered for the offences punishable under Section 109 of BNS, 2023 and Section 27(2) of the Arms Act, later on charge has been framed under Sections 103(1) of the BNS, 2023 and Section 25(1A) and 27(3) of the Arms Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner committed murder of Amita Khalko. It is submitted that the allegation against the petitioner is false. It is next submitted that the PW-1 who is supposed to an eye witness has not supported the case of the prosecution in the trial, in which she has been examined as PW-1 and she has turned hostile and even though the prosecution put leading questions to her still she did not support the case of the prosecution. It is next submitted that the PW-2 who is the informant of the case has also stated that he has not seen any occurrence in his own eyes. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-20 of this bail application. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the informant or witnesses of the case. It is lastly submitted that the petitioner has been in custody since 08.05.2025 as mentioned in para-19 of the instant bail application. Hence it is submitted that the petitioner be released on bail.
Learned Addl.P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judicial Commissioner-XII, Ranchi in connection with S.T. Case No.576 of 2025 arising out of Mandar P.S. Case No.57 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case.
