Kausik (Rejected) CRM (NDPS) 1742 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Lalgola Police Station Case No. 895/2024 dated 30.08.2024 under sections 21(C), 29 of the NDPS Act, 1985. And In the matter of : Anikul Islam ……Petitioner. Mr. Sagar Saha ……for the Petitioner. Ms. Manisha Sharma, Ld. JGA Ms. Sima Biswas ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 1 year 5 months and till date charge has not been framed. Learned advocate for the State submits that 328 Gms. of Heroin was seized from the possession of the petitioner. Having regard to the fact that the substance so recovered is of commercial quantity, I am not inclined to release the petitioner on bail. However, State would take steps for expediting the progress of the case. It has been informed charge till date has not been framed. Efforts be put in for overcoming the stage of 2 consideration of charges and proceeding with the trial of the case. Accordingly, CRM (NDPS) 1742 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
