Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents 2 to 4 in not releasing the essential commodities and not continuing me as Fair price shop dealer for FP Shop No.0824033, Kothapeta Village, Vetapalem Mandal of Bapatla District, without there being any suspension or cancellation of my authorization, as illegal, irregular, irrational, violative of provisions of Andhra Pradesh State Public Distribution Control Order, 2008 and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents particularly respondents to continue the petitioner as Fair Price Shop Dealer for the above said Fair price shop by supplying essential commodities every month for distribution to cardholders, and to pass such IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the respondents 2 to 4 to continue me as Fair price shop dealer for FP Shop No.084033, Kothapeta Village, Vetapalem Mandal of Bapatia District by supplying essential commodities every month for distribution to cardholders, pending disposal of main Writ Petition and pass such Counsel for the Petitioner:

The above writ petition was filed to declare the action of respondents 2 to 4 in not releasing the essential commodities to the petitioner’s F.P.Shop No.0824033, Kothapeta village, Vetapalem Mandal, Bapatla District, pursuant to the show cause notice, dated 08.03.2026 (Ex.P1), without passing any orders, as illegal and arbitrary. Today, when the matter is taken up, Sri Vineeth Appasani, learned Assistant Government Pleader for Civil Supplies, for the respondents, submitted that respondent No.3 passed an order vide Ldis H/180/2026, dated 23.03.2026, cancelling the petitioner’s authorisation. 3. A copy of the proceedings is placed before the Court. As seen from the proceedings, pursuant to the show cause notice dated 08.03.2026, respondent No.3 passed an order on 23.03.2026 cancelling the petitioner’s authorisation. Since the writ petition is filed questioning the action of the respondent authorities in not releasing the essential commodities, the relief sought cannot be granted to the petitioner. 4. Hence, this writ petition is dismissed. However, this order will not preclude the petitioner from challenging the order passed by respondent No.3 vide Ldis H/180/2026, dated 23.03.2026, before the appropriate forum. No costs.
