ORDER A.No.1608 of 2026 has been filed by the ninth respondent in E.P.No.112 of 2015, who is one of the joint decree-holders brought on record as a legal heir of the deceased original decree-holder, seeking condonation of 5/8 https://www.mhc.tn.gov.in/judis A. Nos. 1608 and 2626 of 2026 a delay of 111 days in preferring an appeal against the order dated 27.10.2025 passed by the learned Master. The first respondent herein is the second petitioner in the Execution Petition and another joint decree-holder prosecuting the execution proceedings. 2. Despite sufficient opportunity, the respondents have not filed any counter. Considering the reasons stated in the affidavit and to allow the applicant to prosecute the appeal on the merits, this Court is inclined to condone the delay, subject to payment of costs. 3. Accordingly, A.No.1608 of 2026 is allowed, and the 111-day delay is condoned, subject to the applicant paying Rs.5,000/- as costs to the first respondent within two weeks of receipt of a copy of this order. On production of proof of payment, the appeal shall be numbered if it is otherwise in order. 4. The same applicant has filed A.No.2626 of 2026 to set aside the order dated 17.06.2026, under which the learned Master directed the execution of the delivery warrant, returnable by 10.07.2026.
