2. This is an application under Section 482 of the BNSS, 2023 whereby the petitioner, Julhash Uddin Ahmed is seeking Anticipatory Bail apprehending arrest
Page No.# 2/2 in connection with an FIR, which is registered as Laluk Police Station case No. 68/2026 registered under Sections 221 of BNS, 2023 read with Sections 21(b)/27(A)/29 of the NDPS Act.

It appears from the FIR that two other accused persons have named therein were apprehended when they were travelling on an e-rickshaw and an intermediate quantity of suspected heroin was recovered from the back side of the said e-rickshaw and when the police apprehended the said accused persons and were in that process of taking him away to the police station, the present petitioner, who was the gaonpradhan obstructed the police officers.
4. It appears from the case diary that no physical act of obstruction has been attributed to the petitioner and only use of slung language has been mentioned.
5. Having regard to the above, it appears that the provisions of the NDPS Act is not attracted in the present case as far as the present petitioner is concerned. Accordingly, the prayer for pre-arrest bail is allowed. Petitioner, Julhash Uddin Ahmed, in the event of his arrest in connection with the aforesaid case shall be released on interim bail of ₹50,000/- (Rupees fifty thousand) only with 2 (two) sureties of like amount to the satisfaction of the Arresting Authority.
6. It is further provided that the petitioner shall appear before the Investigating Officer within a period of 10 (ten) days from today for the purpose of interrogation and shall co-operate with the investigation.
7. Accordingly, the Anticipatory Bail petition is disposed of.
