On a previous occasion, the petitioner had filed a writ petition, being W.P.A. No. 10458 of 2022, raising substantially the same allegation against respondent no. 6. By an order dated 7 February 2023, a Coordinate Bench of this Court disposed of the said writ petition, inter alia, observing that if it were found that the construction had been carried out under a Government Housing Scheme, the appropriate remedy of the petitioner would lie before the Civil Court. The Panchayat Pradhan was also directed to consider the grievance of the petitioner in accordance with law. 2 Learned counsel appearing for the petitioner submits that the aforesaid order has not been complied with. Learned counsel appearing for respondent no. 6, on the other hand, submits that the building in question has been constructed under the Pradhan Mantri Awas Yojana. In view of the foregoing, the present writ petition is disposed of with a direction upon the Pradhan, Frezerganj Gram Panchayat (respondent no. 5), to afford an opportunity of hearing to the petitioner as well as respondent no. 6 and to pass a reasoned order within a period of one month from the date of communication of this order, in terms of the order dated 7 February 2023 passed in W.P.A. No. 10458 of 2022. (Kausik Chanda, J.)
