C.M.P.No.14031 of 2026 in C.M.A.Sr.No.39264 of 2026 N.ANAND VENKATESH , J 1st Respondent has been served with notice and he represented through counsel. 2.Notice to the 2nd respondent is dispensed with, since he remained ex-parte before the Tribunal. But however, notice served and the name has been printed in the cause list. 3.The learned counsel for the petitioner submitted that in the accident, one and half year child lost her life and the father filed a claim petition in which compensation was awarded and he received the compensation. Thereafter, the grand parents filed a claim petition which was later dismissed for default. Concealing the same, yet another claim petition was filed in MACTOP No.1806 of 2011 by the grandmother and once again an Award has been passed. 4.Considering the peculiar facts of this case, where more than one claim has been made for the same accident, this Court is inclined to condone the delay. 5.Accordingly, the miscellaneous petition is allowed and the delay of 4141 days in filing the above appeal is condoned. https://www.mhc.tn.gov.in/judis N.ANAND VENKATESH, J ssr 6.Registry is directed to number the main Civil miscellaneous appeal, if it is otherwise in order and list the same for admission in due course.
