P V KRISHNAIAH The Court made the following: 5 JUDGMENT: (Per Hon’ble Sri Justice D.Ramesh) The Writ Appeal is filed by third parties aggrieved by the orders dated 07.02.2025 in W.P.No.4149 of 2021 wherein learned single Judge has set aside the integrated seniority list dated 30.11.2020 issued by respondent no.1 therein (respondent no.7 herein) and further directed the respondents to prepare a fresh final seniority list of Deputy Executive Engineers in terms of Rule 33, 33(b) and Rule 34 of A.P.State and Subordinate Service Rules (for short the Rules), in accordance with law. 2. Heard Sri P.Amarender, learned counsel for the appellants, learned Government Pleader for respondents. 3. Admittedly, the appellants as well as unofficial respondents are all appointed as Assistant Executive Engineers. The posts of Deputy Executive Engineer is Zonal cadre and the next post Executive Engineer is a State cadre and integrated seniority list was prepared on 30.11.2020 in terms of Rule 34 of the Rules. 4. The petitioners in the Writ Petition belongs to zone-II and the seniority has been prepared in terms of Rule 33 of the Rules taking the date of joining. Basing on the zonal seniority list, the respondents have prepared and finalized integrated seniority list on 30.11.2020 in terms of Rule 34 of the Rules. The petitioners have no grievance with regard to preparation of integrated seniority list, but if they have any grievance 6 with regard to preparation of zonal seniority list, the same has not been assailed within time. In fact after finalization of integrated seniority list on 30.11.2020, all the petitioners and unofficial respondents herein have got promotions as Executive Engineers based on the said integrated seniority list. Out of 130 Deputy Executive Engineers, more or less 120 Deputy Executive Engineers were promoted to the post of Executive Engineers except the appellants herein and implead petitioners. 5. Learned counsel appearing on behalf of the appellants has submitted that the writ petition itself is not maintainable on the ground of not impleading effected persons as party respondents. In fact the petitioners have not challenged the zonal seniority list in time. Without challenging the same, they are estopped to challenge the integrated seniority list. Further he has also placed reliance that once the integrated seniority list is prepared and promotions are affected more than 120 persons by virtue of the impugned orders only the appellants and implead petitioners were not got promotions. 6. Considering the submissions made by the appellants and the implead petitioners, the impugned orders in W.P.No.4149 of 2021 at paragraph no.11 are set aside with a further direction to respondents to complete the promotions as per the integrated seniority list dated 30.11.2020. However as contended by the petitioners in the Writ 7 Petition, let the authorities may first finalize the zonal seniority list in terms of Rule 33 Proviso to 33(b) of the Rules after that if any requirement of modification of integrated seniority list is required, let a separate proceedings may initiate by issuing notices to the affected persons in accordance with Rule 34 of the Rules. It is needless to say that the authorities may affect promotions without reference to the memo dated 25.6.2026. 7. Accordingly, the Writ Appeal is disposed of. No costs.
